Regulation (EC) No. 1907/2006

REACH Only Representative

The import of chemical substances into the European Union is regulated by the REACH Regulation (EU Regulation No. 1907/2006).

This Regulation obliges European companies to register all substances they import into Europe in quantities of 1 tonne or more per year. These registrations entail high economic costs that not all companies can afford, which is why more and more companies are reducing their imports and increasing their purchases of chemicals within Europe.

Non-European manufacturers exporting chemicals to Europe may designate a European company to act as their Representative and register the substances.

In this way, they gain a commercial advantage over their competitors by avoiding the need for their European customers to register their substances, thus saving them the financial outlay involved.

Reasonably, European companies are attracted to those suppliers who release them from their obligations under REACH and who in turn maintain the competitiveness that characterises suppliers from outside the EU.

In order to facilitate the entry into Europe of all non-EU manufacturers, we offer the Only Representation service to non-EU manufacturers, guaranteeing them compliance with the legislation in Europe.

Frequently Asked Questions about Exclusive Representative (OR)

Appointing an Only Representative gives you an immediate competitive business advantage immediate. By assuming the registration obligations for your substances, you free your European customers from the legal and financial burden of having to register them themselves as importers. This makes European companies preferable to buying your products over those of non-EU competitors who do not offer this service, thus eliminating barriers to entry into the European market.

As your Exclusive Representative, ServiREACH acts as a legal entity established in the EU that assumes full responsibility for compliance with the REACH Regulation for the substances you export. We take care of carrying out the registration of the substances with ECHA, managing the technical documentation, and ensuring that your exports comply with the regulation, allowing you to operate in Europe as if you were a local manufacturer.

If you do not appoint an OR, the legal obligation automatically falls on your importer customers in the European Union. They will have to bear the high costs and procedures of registration if they import more than 1 ton annually. Since many European companies cannot or do not want to bear these costs, they are likely to reduce their imports or seek suppliers within the EU, which could cause you to lose customers.

The REACH Registration obligation mandatorily applies to substances imported into the European Union in quantities equal to or greater than 1 tonne per year.. If your exports exceed this threshold, registration is mandatory. ServiREACH helps you manage this process regardless of volume, ensuring that, as your business grows, you continue to meet the legal requirements for larger volumes.

Your European customer goes from being considered an “importer” (with complex and costly registration obligations) to being considered a “downstream user”. This drastically simplifies their administrative burden, as they do not have to register the substance, only use it in accordance with safety conditions. Basically, you save them time, money, and legal responsibility, which is a very powerful selling point for customer retention.
