Regulation (EC) No 1935/2004 applies to materials and finished articles which are intended or likely to come into contact with food or which will transfer their constituents to food under normal or foreseeable conditions of use.
The materials and articles must be manufactured in accordance with good manufacturing practice (Regulation (EC) No 2023/2006) so that, under normal or foreseeable conditions of use, they do not transfer their constituents to food in quantities which may represent a hazard to human health, lead to an unacceptable change in the composition of the food or to an alteration in its organoleptic characteristics.
The regulation establishes groups of materials and objects: active and intelligent materials and objects, adhesives, ceramics, cork, rubber, glass, ion exchange resins, metals and alloys, paper and cardboard, plastics, printing inks, regenerated cellulose, silicones, textile products, varnishes and coatings, waxes, wood.
For these materials and articles, their combination and/or recycling, specific measures may be taken (at Community or national level) including the listing of substances authorised for use in the manufacture of these materials and specific limits on the migration of components into food.
In whatever circumstances, and in a common form whatever the type of material used, the labelling, advertising and presentation of these materials or articles should not mislead the consumer and should clearly indicate that they may come into contact with food.
