What does Regulation (EU) 2026/405 on detergents change and how does it affect my company?

The European Union has taken a step forward with the approval of Regulation (EU) 2026/405 on detergents and surfactants, which will progressively replace the current legislation and modernise the regulatory framework for the sector.

What does Regulation (EU) 2026/405 change and how does it affect my company?

Detergents are substances, mixtures or microorganisms intended for cleaning and, in Europe, are currently regulated by Regulation (EC) No 648/2004. The approval of the new Regulation (EU) 2026/405 responds to the technological and industrial developments of recent years and has the main objectives of strengthening the protection of human health and the environment, promoting innovation, supporting the circular economy and advancing the digitalisation of product information.

What new features does Regulation (EU) 2026/405 introduce?

The main changes include:

• Specific requirements for detergents containing microorganisms.
• Circular economy. Refill and reusable packaging systems are regulated in order to promote more sustainable consumption models.
• E-commerce. Specific obligations are introduced for distance selling and digital platforms.
• Reduction of animal testing. The Regulation promotes the use of alternative methods whenever possible.
• Greater responsibility for the authorised representative. Their obligations are expanded and include, among others:
  • keeping documentation for at least ten years;
  • verifying compliance;
  • maintaining and updating product information;
  • cooperating with the competent authorities.
• Digital Product Passport. One of the most relevant new features is the introduction of a digital information system that will accompany the product throughout its life cycle. This will include:
  • a unique product identifier;
  • identification of the responsible economic operator;
  • a digital data carrier, such as a QR code;
  • a system that facilitates traceability and supervision by the authorities.

The implementation of this system will help improve product traceability, increase transparency across the supply chain and reduce part of the administrative burden for companies.

What aspects remain unchanged?

Although the Regulation introduces important new requirements, it also maintains some of the fundamental principles of the current regulation, such as:

• biodegradability requirements for surfactants;
• restrictions applicable to phosphates;
• general principles of chemical safety.

This will facilitate the adaptation of manufacturers and distributors to the new regulatory framework.

Application timeline

Regulation (EC) No 648/2004 will be repealed on 23 September 2029. However, the new Regulation provides for transitional periods that will allow certain products compliant with the previous legislation to continue being placed on the market until 2030, provided that the established conditions are met.
