{"id":16677,"date":"2026-05-11T09:16:12","date_gmt":"2026-05-11T07:16:12","guid":{"rendered":"https:\/\/servireach.com\/blog\/the-eu-tightens-restrictions-on-microplastics-key-points-to-understand-reach-restriction-no-78-and-the-new-pellets-regulation\/"},"modified":"2026-05-11T09:30:17","modified_gmt":"2026-05-11T07:30:17","slug":"the-eu-tightens-restrictions-on-microplastics-key-points-to-understand-reach-restriction-no-78-and-the-new-pellets-regulation","status":"publish","type":"post","link":"https:\/\/servireach.com\/en\/blog\/the-eu-tightens-restrictions-on-microplastics-key-points-to-understand-reach-restriction-no-78-and-the-new-pellets-regulation\/","title":{"rendered":"The EU tightens restrictions on microplastics: key points to understand REACH Restriction No. 78 and the new Pellets Regulation"},"content":{"rendered":"\n<p>The deadline for manufacturers and industrial users to notify ECHA of their microplastics uses and emissions corresponding to the 2025 reporting year is 31 May 2026.<\/p>\n\n<p>One of the functions of the European REACH Regulation is to restrict or prohibit the manufacture, placing on the market or use of specific chemical substances in order to protect human health and the environment.<\/p>\n\n<p> One of the affected substances is <strong>synthetic polymer microparticles (SPMs)<\/strong>, also known as microplastics, through <strong>Restriction No. 78<\/strong> of <strong>Annex XVII<\/strong> of the REACH Regulation.<\/p>\n\n<p>This measure forms part of the European strategy to reduce plastic pollution and its environmental impact, particularly in aquatic ecosystems, and establishes new progressive obligations for manufacturers, importers and industrial users.<\/p>\n\n<div style=\"height:33px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<h2 class=\"wp-block-heading\">What is considered a microplastic under REACH?<\/h2>\n\n<p>According to Restriction No. 78 of Annex XVII, <strong>synthetic polymer microparticles <\/strong>are solid polymers that simultaneously meet the following conditions:<\/p>\n\n<ul style=\"line-height:1.7\" class=\"wp-block-list\">\n<li><strong>Presence in particles<\/strong>: They constitute <strong>\u22651% by weight <\/strong>of the particles or form a continuous surface coating on them.<\/li>\n\n\n\n<li><strong>Critical dimensions<\/strong>: At least <strong>1% by weight<\/strong> of the particles meet one of the following criteria:\n<ul class=\"wp-block-list\">\n<li>Dimensions <strong>\u22645 mm<\/strong>; or<\/li>\n\n\n\n<li>Length <strong>\u226415 mm<\/strong> with a length-to-diameter ratio greater than 3.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<p>In addition, the polymers must be<strong> intentionally<\/strong> present in the product and must not be biodegradable according to the criteria established in the restriction.<\/p>\n\n<div style=\"height:33px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<h2 class=\"wp-block-heading\">Main obligations under REACH Restriction No. 78<\/h2>\n\n<p>The restriction establishes a <strong>progressive ban on placing products on the market<\/strong>, accompanied by transitional periods for specific sectors. Key obligations include:<\/p>\n\n<ul style=\"line-height:1.7\" class=\"wp-block-list\">\n<li><strong>Use restrictions<\/strong>: Affecting products such as cosmetics, detergents and fertilisers according to phased implementation dates.<\/li>\n\n\n\n<li><strong>Instructions for use<\/strong>: Obligation to provide information on how to reduce environmental releases during industrial uses.<\/li>\n\n\n\n<li><strong>Transparency<\/strong>: Strict information requirements regarding the presence of these substances in product technical documentation.<\/li>\n\n\n\n<li><strong><a href=\"https:\/\/echa.europa.eu\/hu\/support\/dossier-submission-tools\/reach-it\/microplastics-reporting\">ECHA notification<\/a><\/strong>: Obligation to submit annual reports on uses and estimated emissions.<\/li>\n<\/ul>\n\n<div style=\"height:34px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<h2 class=\"wp-block-heading\">New obligations: pellets and implementation phase<\/h2>\n\n<p>In addition to REACH, <strong><a href=\"https:\/\/eur-lex.europa.eu\/eli\/reg\/2025\/2365\/oj\/eng\">Regulation (EU) 2025\/2365 <\/a><\/strong>has introduced specific requirements for <strong>plastic pellets<\/strong>. This Regulation establishes measures to prevent pellet losses into the environment during handling, transport and use. <\/p>\n\n<p>Among the new obligations is the implementation of<strong> pellet loss prevention plans<\/strong>, reinforcing supply chain controls without changing the overall EU objective of reducing microplastic pollution.<\/p>\n\n<div style=\"height:34px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<h2 class=\"wp-block-heading\">Impact on companies and key deadlines<\/h2>\n\n<p>These changes will have a significant impact on sectors such as cosmetics, detergents, fertilisers and industrial products, which will need to:<\/p>\n\n<ul style=\"line-height:1.7\" class=\"wp-block-list\">\n<li>Review product formulations<\/li>\n\n\n\n<li>Assess the presence of synthetic polymers in mixtures<\/li>\n\n\n\n<li>Adapt labelling and user information<\/li>\n\n\n\n<li><strong>Submit <a href=\"https:\/\/echa.europa.eu\/hu\/support\/dossier-submission-tools\/reach-it\/microplastics-reporting\">ECHA notifications<\/a> (<em>microplastics reporting<\/em>). Key deadlines:<\/strong>\n<ul class=\"wp-block-list\">\n<li><strong>31 May 2026<\/strong>. Deadline for manufacturers and industrial users to report the use of microplastics in the form of granules, flakes and powders, including polymer types and emissions generated during 2025. <\/li>\n\n\n\n<li><strong>31 May 2027<\/strong>.
