Why? Because the new regulation requires that <strong>EU fertilising products bearing the CE marking<\/strong> contain substances specifically registered for their use as EU fertilisers.<\/p>\n<p>And this is where the questions begin.<\/p>\n<h2><strong>What is an EU fertilising product?<\/strong><\/h2>\n<p>A fertilising product that bears the <strong>CE marking<\/strong> when placed on the market<span style=\"color: initial;\">.<\/span><\/p>\n<p class=\"SRHNormal\"><span lang=\"EN-GB\">Among other requirements, it can only be marketed as an EU fertilising product if the substances it contains comply with REACH.<\/span><\/p>\n<h2><strong>Must all substances be registered under REACH?<\/strong><\/h2>\n<p class=\"SRHNormal\"><span lang=\"EN-GB\">The <b>Component Material Categories (CMC)<\/b> define the requirements that substances must meet, including whether they must be registered under REACH with a dossier containing at least:<\/span><\/p>\n<ul>\n<li>The information requirements applicable to the <strong>&gt;10 tonnes\/year tonnage band<\/strong> under REACH, and<\/li>\n<li>A <strong>Chemical Safety Report (CSR)<\/strong>, prepared in accordance with REACH, covering the use of the substance as a fertiliser.<\/li>\n<\/ul>\n<p>This means that even substances manufactured or imported at <strong>less than one tonne per year<\/strong>, if they are intended to be used in a CE-marked fertilising product, must be registered under REACH.<\/p>\n<h2><strong>If I already have a registered substance, do I need to update my REACH registration?<\/strong><\/h2>\n<p>Possibly yes. If your company has registered a substance and now intends to place it on the market as part of a CE-marked fertiliser, you must ensure that the REACH registration dossier meets the minimum requirements established by the FPR.<\/p>\n<p>Updating your REACH registration to cover this use may involve:<\/p>\n<ul>\n<li>Drafting new <strong>exposure scenarios<\/strong>.<\/li>\n<li>Conducting new studies or risk assessments.<\/li>\n<li>Updating the <strong>CSR (Chemical Safety Report)<\/strong>.<\/li>\n<\/ul>\n<h2><strong>I have a substance registered at &gt;10 t\/year with several assessed uses, but none as a fertiliser. What should I do?<\/strong><\/h2>\n<p>This is a common situation. The answer depends on your role in the supply chain:<\/p>\n<ul>\n<li><strong>If you are the registrant of the substance:<\/strong>\n<ul>\n<li>Extend the scope of your registration to include the use as a fertiliser, updating your dossier with new exposure scenarios. This includes:\n<ul>\n<li>Describing the use as an EU fertiliser.<\/li>\n<li>Assessing the risks related to this use.<\/li>\n<li>Adding the corresponding scenario to the CSR.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li><strong>If you purchase the substance from an EU supplier:<\/strong>\n<ul>\n<li>Ask your supplier to provide exposure scenarios including the use as an EU fertiliser.<\/li>\n<li>If they do not have these (and do not intend to generate them), you will need to find another supplier that does.<\/li>\n<li>Alternatively, you can prepare your own <strong>Chemical Safety Report as a downstream user<\/strong>, assessing the use of the substance as a fertiliser.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h2><strong>Are there exemptions?<\/strong><\/h2>\n<p>Yes. The exemptions from REACH registration referred to in the FPR include:<\/p>\n<ul>\n<li>Substances listed in <strong>Annex IV of REACH<\/strong> (substances with sufficient information and considered to present minimal risk).<\/li>\n<li>Substances described in points 6, 7, 8 and 9 of <strong>Annex V of REACH<\/strong> (substances for which registration is considered inappropriate or unnecessary).<\/li>\n<\/ul>\n<p>In addition, a company may choose to market the fertilising product without CE marking.
