This may impose limitations for manufacturers, importers, and distributors.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The restrictions may apply to:<\/p>\n<\/div>\n<\/div>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Pure substances.<\/li>\n\n\n\n<li>Mixtures containing them.<\/li>\n\n\n\n<li>Finished articles that may release such substances.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">This is why it is essential to <strong>identify whether any substance used in your processes or products is subject to restrictions.<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Are there exceptions to these restrictions?<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Yes. Although the restrictions of Annex XVII are legally binding, there are specific exceptions in certain cases. For example:  <\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><em>Scientific research and development<\/em>: The use of some restricted substances is allowed for laboratory purposes.<\/li>\n\n\n\n<li><em>Cosmetics<\/em>: If the risk is limited to human health and covered by other legislation.<\/li>\n\n\n\n<li><em>On-site isolated intermediates<\/em>: Used during closed industrial processes.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">These exceptions must be carefully evaluated, as they do not apply broadly.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>How is Annex XVII updated?<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Annex XVII is not static. It can be modified or expanded based on new scientific evidence or risk assessments. This process may be initiated by:  <\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>a Member State,<\/li>\n\n\n\n<li>the ECHA (European Chemicals Agency), or<\/li>\n\n\n\n<li>the European Commission.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">When an i<strong>nadequately controlled risk is identified<\/strong>, a <strong>restriction dossier is prepared<\/strong>, which must be completed within 12 months. During this process, stakeholders are invited to submit comments or observations within a six-month period. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Once the dossier is submitted, ECHA committees evaluate:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The risk to <strong>human health and the environment.<\/strong><\/li>\n\n\n\n<li>The <strong>socioeconomic <\/strong>impact of implementing a restriction.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">These evaluations ensure that any future decision is <strong>based on sound scientific and economic data<\/strong>, and is adopted in a <strong>transparent and participatory manner.<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>What are the consequences of non-compliance?<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Each Member State is responsible for ensuring that Annex XVII restrictions are enforced.
